About this policy

NDHM PARK, operated by High & Rose LLC (“we”, “us”), runs the parking lot at 315 E High St, Lexington, KY 40507 and the website ndhmpark.com (the “Site”). This policy describes how we collect, use and protect information from people who visit the Site, buy a permit, or contact us. By using the Site you agree to the practices described here. We may update this policy at any time; continued use of the Site means you accept the current version.

Information we collect

Personal information you give us: your name, email address, phone number, license plate and vehicle description when you buy a permit or fill in a form; and billing details, which are collected by our payment processor under PCI standards and never stored on our servers.

Non-personal information collected automatically: IP address, browser and device type, pages viewed, time on the Site, referring pages and standard server logs. We use this in aggregate to keep the Site working and understand how it is used. We do not run advertising trackers.

How we use your information

• To sell and bill monthly permits, send receipts and renewal or failed-payment notices, and let you manage or cancel your permit.
• To enforce the lot: your license plate, name and phone number appear on the list of authorized vehicles that our towing contractor checks before removing a vehicle.
• To answer your questions and respond to the contact form.
• To send the one-time permit link when you text PARK or ask for it on the form.
• To prevent fraud and misuse of the lot or the Site.

We do not send marketing email or marketing texts. Any permit-related email you receive is transactional.

SMS communications

If you opt in to SMS messaging by texting PARK to our number or by ticking the box on our contact form, you consent to receive automated text messages from NDHM PARK related to your permit inquiry, including the link to buy a permit. Message and data rates may apply. Message frequency varies. Reply STOP to unsubscribe at any time. Reply HELP for assistance or contact us at park@ndhmpark.com. Carriers are not liable for delayed or undelivered messages.

We will never sell, rent, or share your mobile number with third parties or affiliates for marketing or promotional purposes. SMS opt-in data and consent will not be shared with any third party except service providers that help us deliver messages.

Payment data

We do not store credit or debit card numbers on our servers. All payments are processed by Stripe, a PCI-compliant third-party processor, under Stripe’s own privacy policy. We see the last four digits of your card, the billing name and the payment status, which we need to run your permit.

Data retention

Permit and payment records are kept for as long as your permit is active and afterward for the period required for tax and accounting purposes, generally up to seven years. Contact-form messages are kept for up to two years. You may ask us to delete your account information once your permit has ended by emailing us; we will do so unless the law requires us to keep it.

Third-party services

We work with a small number of service providers who receive your information only as needed to do their job and are not permitted to use it for anything else: Stripe (payments and billing), our towing contractor (license plate, name, phone number and permit status, for enforcement only), our text-messaging provider (delivering the PARK reply), and our email and hosting providers. We are not responsible for the privacy practices of websites we link to.

Your rights

You may ask to see the personal information we hold about you, correct it, or have it deleted, and you may withdraw consent to text messages at any time by replying STOP. Send requests in writing to park@ndhmpark.com. Update your card, plate or contact details, or cancel your permit, from the manage-my-permit link in any receipt.

Cookies

The Site uses only the cookies needed for it to function and for Stripe’s checkout to work. We do not use advertising cookies. You can disable cookies in your browser; some parts of checkout may not work if you do.

Security

We take reasonable steps to protect your information, and payments are handled entirely by Stripe. No method of transmission over the internet is completely secure, so we cannot guarantee absolute security. You are responsible for keeping any login you use for your permit private.
